====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in connection with Sherghati P.S. Case No. 431 of 2017 for the offence under Section 30 (a) (d) of Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 60 kg of Mahua was seized. The petitioner is in custody since 29.06.2019.

Considering the fact that the petitioner has no criminal antecedent and having regard to the quantity of raw material for manufacturing Mahua liquor seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 25,000/- (twenty five thousand) in the Court below and on

Patna High Court CR. MISC. No.53031 of 2019(2) dt.29-08-2019 2/2 deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya, in connection with Sherghati P.S. Case No. 431 of 2017. The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
