2. The petitioner has prayed for bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

3. As per allegation in the FIR, 5-6 unknown miscreants by covering their faces and on pistol point took away Rs. 1,68,975/-, 7 T. Shirts and mobiles. It is further alleged that they broke the DVR of CCTV and confined the informant and other staffs in a room and closed the shutter and fled away. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR not put on TIP. Except one one T.Shirt , nothing has been recovered from possession of the

Patna High Court CR. MISC. No.56344 of 2023(2) dt.05-09-2023 2/2 petitioner. On suspicion petitioner was arrested and his forceful confession was extracted by the police. Petitioner is languishing in judicial custody since 14.6.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Arwal in connection with Arwal P.S.
