2. The petitioner has preferred this application for grant of regular bail in connection with Andharathadhi P.S. Case No. 39 of 2025 bearing G.R. 481 of 2025 dated 21.03.2025 registered for the offences punishable u/s 309(4) of the BNS.

3. As per the prosecution case, three unknown miscreants ridden on motorcycle are alleged to have snatched the informant's motorcycle, Rs. 5500/- and a mobile phone on the point of pistol and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of

Patna High Court CR. MISC. No.55557 of 2025(2) dt.11-11-2025 2/3 the petitioner has sprung up in the confessional statement of the co-accused Nitish Kumar Yadav. Nothing has been recovered from the conscious possession of the petitioner. No TIP has been conducted by the prosecution. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 26.03.2025. The co-accused person has already been granted regular bail by this Court vide order dated 07.07.2025 passed in Cr. Misc. No. 39163 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Andharathadhi P.S. Case No. 39 of 2025 bearing G.R. 481 of 2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
