2. The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 228 of 2025 for the offences registered under Section 317(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, there is recovery of 362.70 litre foreign liquor from the Hyundai Car which was driven by the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is neither driver nor owner of the said vehicle. In fact, driver of the vehicle had requested the petitioner to sit in the vehicle as he was unknown to the area and petitioner being
Patna High Court CR. MISC. No.57974 of 2025(2) dt.04-09-2025 2/2 bonafide with intention to help him sat in the vehicle. He had no knowledge about the seized liquor. There is no compliance of Section 103 of the B.N.S.S. Petitioner has no criminal antecedent. He is in judicial custody since 01.07.2025. Petitioner undertakes to co-operate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge V-cumSpecial Judge (Excise-1), Madhepura in connection with Singheshwar P.S. Case No. 228 of 2025.
