Petitioner is named in the first information report with specific allegation that he along with others dragged informant's wife from her house and after that her dead body was found hanging with a tree.

The contention on behalf of the petitioner is that other accused faced trial in Sessions Trial no. 538/2014 and in the aforesaid session trial witnesses did not support the prosecution case and having considered the prosecution evidence, trial court acquitted other accused.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on anticipatory bail and accordingly, his prayer for anticipatory bail in connection with Paroo P.S. Case no. 140/2013 pending in the court of

Patna High Court Cr.Misc. No.40019 of 2014 (3) dt.07-05-2015 the Sub divisional Judicial Magistrate (west), Muzaffarpur stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
