Petitioner seeks bail in a case registered under sections 272, 273 of the Indian Penal Code and 47(A) of the Excise Act. Near about 407 liters Indian made foreign liquor were recovered from a pick-up van which was being driven by the petitioner at the time of alleged occurrence and one Hira Lal Chaurasiya @ Matar Lal Chaurasiya was also found sitting in the aforesaid pick-up van and he, too, was arrested by the informant. Moreover, Hira Lal Chaurasiya @ Matar Lal Chaurasiya disclosed that seized liquor belonged to co- accused Krishnanandan Chaudhary and others.
Submission on behalf of the petitioner is that co-accused Hira Lal Chaurasiya @ Matar Lal Chaurasiya has already been granted privilege of bail by a coordinate bench of this court vide order
Patna High Court Cr.Misc. No.37043 of 2016 (2) dt.05-09-2016 dated 30.5.2016 passed in Cr. Misc. no. 23155/2016. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 18.3.2016, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesganj P.S. Case no. 126/2016.
