Petitioners apprehend their arrest in connection with Baikunthpur P.S.Case No. 94 of 2018 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.
Petitioners are said to be father-in-law, brother-in-law and other relatives of the deceased and the case is of dowry death. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the petitioners and deceased died due to illness.
Heard learned APP also, who has opposed the prayer for anticipatory bail stating that dead body of the deceased was
Patna High Court Cr.Misc. No.48808 of 2018 (2) dt.25-08-2018 2/2 disposed of without informing the father of the deceased. Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Niraj Kumar Pandey, Judicial Magistrate, 1st Class, Gopalganj, in connection with Baikunthpur P.S.Case No. 94 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
