Mr. Sc28- Ajeet Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-07-2018 I.A. No. 7704 of 2016 has been filed for substitution of legal heirs of the original writ petitioner who died on 31.01.2015.

For the reasons stated in the interlocutory application, the same is allowed and in place of original writ petitioner, the heirs as mentioned in para-5 of the I.A. No. 7704 of 2016 namely Upendra Choudhay may be substituted.

In view of the subsequent development after the death

Patna High Court CWJC No.16451 of 2014(3) dt.26-07-2018 2/2 of the original writ petitioner, the grievance is confined to payment of salary for the period of two months prior to 24.12.2012.

In view of the aforesaid, the writ petition is disposed of with direction to the respondents to examine the case of the original writ petitioner and if it is found that original writ petitioner was not paid salary for the period of two months prior to 24.12.2012, appropriate decision may be taken by the respondents within four months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
