The petitioner seeks bail in Laukaha P.S. Case No. 163 of 2017 registered under Section 25 (1-b) A/26/35 of the Arms Act.

As per the prosecution case, a country made pistol is said to have been recovered from the possession of co-accused Sanjay Ram and Lalit Ram each who have claimed to have purchased the said pistols from the petitioner. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. There is nothing on record to indicate the complicity of the petitioner in the

Patna High Court Cr.Misc. No.50103 of 2017 (02) dt.17-10-2017 2/ 2 occurrence barring the statement of co-accused. The petitioner has been languishing in custody since 05.08.2017 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No.163 of 2017.
