2. The petitioners apprehend their arrest in connection with Lakhisarai Mahila P.S. Case No. 25 of 2023 registered for the offence punishable under Sections 341, 323, 379, 498A and 494 / 34 of the Indian Penal Code.
3. The allegation against the petitioners is that they alongwith co-accused had tortured the informant due to nonfulfillment of demand of dowry and the husband of the informant remarried with another person.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.57372 of 2023(2) dt.13-09-2023 2/3 petitioners are mother-in-law and father-in-law of the informant, who had no concern with the affairs of the informant and her husband. Petitioners are innocent and have falsely been implicated in this case. They had earlier filed a complaint case which was dismissed and thereafter this false F.I.R. has been lodged by the informant against them. The husband of the informant has earlier filed a Matrimonial Suit for restoration of conjugal right vide Case No. 47 of 2019 but the informant could not reconcile to live with her husband and thereafter the husband of the informant has filed the divorce case. There is no specific allegation against the petitioners and they have no criminal antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of their arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Lakhisarai in connection with Lakhisarai Mahila P.S. Case No. 25 of 2023, subject to the conditions laid
