JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody in a case registered for the offence punishable under Sections399, 402, 412 of the Indian Penal Code and Sections-25(i-B) 26 & 35 of the Arms Act.

The first information report reflects that petitioner and some others had assembled with an intention to commit an offence and it has not been mentioned specifically in the first information report that petitioner and others had assembled to make preparation for committing dacoity. Moreover, having more or less similar allegation, some co-accused, have already been granted privilege of bail by a coordinate bench of this court.
