The petitioner seeks bail in Saraiya P.S. Case No. 57 of 2017 registered under Section 413 & 414 of the Indian Penal Code.
As per the prosecution case, stolen motorcycle and mobile is said to have been recovered and seized from the possession of the petitioner during the checking of the vehicle. It is submitted by learned counsel for the petitioner that the motorcycle was not recovered from the possession of the petitioner while the mobile phone is hailing to him. Petitioner was going to his relation and was caught by the police in suspicion and roped in this case showing recovery of motorcycle from his possession. Petitioner has clean antecedent. The petitioner has been languishing in custody since 19.02.2017.
