JUSTICE BIBEK CHAUDHURI ORAL ORDER 05-09-2024 The petitioner is the widow of late Vinod Kumar Sharma a Member of Special Auxiliary Police (ASP). The husband of the petitioner unfortunately died in a road traffic accident on 21.05.2020. It is the grievance of the petitioner that the petitioner is entitled to Ex-gratia payment of Rs.10,000,00/- (Rupees Ten lacs only) as her husband died, while performing patrolling duty on road being run over by a vehicle.

2. It is proposed by the learned advocate on behalf of the respondents that the petitioner may be directed to submit a representation before the concerned Superintendent of Police,

Patna High Court CWJC No.12906 of 2024(2) dt.05-09-2024 2/2 Gaya (respondent No.5), who shall take decision in consultation with other respondents as to whether, the petitioner is entitled to get Ex-gratia payment on the death of her husband or not.

3. In view of such submission, the instant writ petition is disposed of directing the respondent No.5 to treat the instant writ petition as a representation and decided the claim of the petitioner, within 60 days from the date of communication of this order.

4. Accordingly, the instant writ petition is thus, disposed of on contest.
