The petitioner apprehends his arrest in a case registered for the offence under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, there is recovery of 108 litres of country made liquor from the bank of Ganga river and on seeing the raiding party twenty to twenty five persons started fleeing away including this petitioner.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He further submits that there is no recovery of incriminating wine from the conscious possession of the petitioner. Petitioner was not apprehended at the spot. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Barh Police Station Case No. 446/2020, subject to condition as laid down under section 438(2) of the code of criminal procedure.
