The petitioner seeks bail in connection with Town P.S. Case No.78 of 2015 registered under Sections 353/34 of the Indian Penal Code.
The accusation is that on receiving secret information that a gang of cutting the shutter headed by the petitioner is making plan to commit the offence at Kalyani Chowk, police reached there. While seeing the police party, all the accused persons started to flee but one of them was apprehended, who disclosed his name Viru Mallik alias Niraj, who, thereafter, disclosed the name of this petitioner and two others to the police.
Patna High Court Cr.Misc. No.25032 of 2015 (3) dt.23-09-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner has not been arrested on the spot by the police rather his name has been disclosed by the co-accused, Viru Mallik alias Niraj. The petitioner is in custody since 27.02.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate at Muzaffarpur, in connection with Town P.S. Case No.78 of 2015. Out of the two sureties, one must be close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
