Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 306 and 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 21.09.2021, is a person with clean antecedent and charge-sheet has been submitted. The informant, who is the Chawkidar, alleges that two days prior to the occurrence, the daughter of Ram Babu Thakur, namely, Amita Kumari fled away with the villager Rajiv Kumar. Thereafter, it is alleged that the boy and the girl were brought to the home by the family members from the police station and
Patna High Court CR. MISC. No.66177 of 2021(2) dt.12-04-2022 2/2 thereafter Amita Kumari committed suicide because of the atrocities being committed by the family members. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Petitioner is the mother of the deceased and the informant is the Chawkidar who is not an eyewitness to the occurrence. It appears that the informant on his own has made false allegation against the petitioner for reason best known to him. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 21.09.2021, is a person with clean antecedent, chargesheet has been submitted and is a woman and the informant is not an eyewitness to the occurrence, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahindwara P.S. Case No. 141 of 2021.
