This is an application of bail in a case of misuse. Initially the petitioner was granted bail in a case registered for the offences punishable under Sections 149, 341, 323, 307, 379 of the Indian Penal Code and 27 of the Arms Act, but the bail bond of the petitioner was cancelled on 09.03.2009. The petitioner was arrested on 10.12.104 and since then he is in custody. It is submitted by learned counsel for the petitioner that the petitioner is ready to appear regularly before the learned court below.

Considering the fact that the petitioner was initially granted bail, period under custody and the impugned

No.22794 of 2015 (2) dt.10-07-2015 2/2 order does not reflect that any progress has been made in the trial after the arrest of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Revilganj P.S. Case No. 47 of 1989 corresponding to U.T. No. 106 of 2014.

The learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
