JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 3⁄4 of Explosive Substance Act. Having heard the sound of explosion, the informant reached near the place of occurrence and found one co-accused, namely, Ramesh Kumar Shrivastav in injured condition. The aforesaid injured person disclosed that one Rajeev Kumar @ Pintu and two unknown used to make bomb with his help. Subsequently, co-accused, Rajeev Kumar @ Pintu was arrested and confessed his guilt disclosing the name of petitioner.

It would appear from the aforesaid facts that except

Patna High Court Cr.Misc. No.36941 of 2016 (2) dt.01-09-2016 2/2 the confessional statement of co-accused, Rajeev Kumar @ Pintu, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Brahampura P.S. Case No. 57 of 2016.
