The petitioner seeks pre-arrest bail in connection with Jokihat P.S. Case No. 11 of 2019 (G.R. No. 44 of 2019) pending in the Court of the Chief Judicial Magistrate, Araria, for the offences alleged under Sections 341, 323, 379, 354B, 427, 436, 506 and 34 of the Indian Penal Code.

The accusation is that at about 10.00 p.m. on 03.01.2019, informant, Arti Marandi, slept in her house after having meal. In the night her neighbour, Munna (petitioner), along with three unknown persons, entered in the house and caught hold of her mouth, she made protest, but, on the point of knife petitioner torn her clothes and took cash of Rs.30,000/- from beneath the bed. At that time the petitioner and other accused persons were also put fire in her house in which house

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
