JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Katihar Barari P. S. Barari (Semapur) P.S. Case No.443 of 2018, disclosing offences under Sections 341, 323, 307, 504, 506, 34 and 302 of IPC.

As per F.I.R. petitioner is said to have assaulted the deceased by iron rod, causing her death.

Submission of the learned counsel for the petitioner is that there is no recovery of iron rod up till now and petitioner has falsely been implicated in this case. Moreover, she is a lady. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is specific allegation against the petitioner, which has been supported by the postmortem report also.

Having heard both sides, in view of the allegations, I
