The petitioner apprehends his arrest for the offences alleged under Sections 363 and 366 of the Indian Penal Code, registered in connection with Fenhara P.S.Case No. 165 of 2021.

As per allegation, the petitioner enticed away the wife and two children of the informant. The informant contacted his wife on mobile and she apprised that she would return till 10th of December.

The learned counsel for the petitioner has submitted that the FIR itself shows that the wife of the informant had apprised him that she would return till 10th of December. She

Patna High Court CR. MISC. No.56292 of 2022(2) dt.07-02-2023 2/2 did not make any allegation of kidnapping to her husband during telephonic conversation.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Fenhara P.S.Case No. 165 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
