The petitioner seeks bail in a case registered under Sections 364, 302 and 201/34 of the Indian Penal Code. Father of the informant is said to have been kidnapped and murdered and his dead body was dumped in the river by the petitioner and four named accused persons over land dispute.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case merely on suspicion and due to land dispute. The allegation levelled against the petitioner is not specific rather general and omnibus
Patna High Court CR. MISC. No.52988 of 2019(3) dt.27-11-2019 2/2 in nature. There is no eye witness of the occurrence. Petitioner has no criminal antecedent and has been languishing in custody since 10.03.2019. Similarly situated four other accused persons have been enlarged on regular bail by different co-ordinate Benches of this Court.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil (Shinghaul O.P.)
