The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 427, 452, 307, 120(B) of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4/5 of the Explosive Substances Act. It is a case of assaulting and recovery of some arms and explosive substances.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. It is further submitted that similarly situated
Patna High Court CR. MISC. No.66424 of 2021(4) dt.22-08-2022 2/2 co-accused have been granted bail by this Hon'ble Court vide order dated 02.08.2022 passed in Cr. Misc. No. 5119 of 2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1st, Muzaffarpur in connection with University P.S. Case No. 31 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
