JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 364, 302 and 201/34 of the Indian Penal Code. The allegation against the petitioner and other coaccused is of kidnapping and killing the younger brother of the informant.

It is submitted on behalf of the petitioner that the petitioner is in custody since 28.02.2016. The petitioner has got no criminal antecedent. Charges have been framed in this case.There is no allegation of tampering with the evidence against the petitioner. The petitioner is not named in the FIR. It is a case of last seen.There is no eye witness to the alleged occurrence. On behalf of the State and the informant, it is submitted

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Sheikhpura in connection with S.Tr. No.26 of 2016 in G.R.No. 1183 of 2015, Ariari (Kasar) P.S.Case No. 116 of 2015.

The petitioner shall be present on each and every date fixed by the trial court. If he fails to do so, the court below will be at liberty to cancel his bail bonds.
