This application for anticipatory bail arises out of Complaint Case No. C-1880 of 2018 for the offence punishable under Section 498A of the Indian Penal Code and Section 3/4 of the D.P.Act.

Learned counsel appearing on behalf of the petitioner, who is husband of the complainant, has submitted that the petitioner has filed a petition for dissolution of marriage in the Court of learned Principal Judge, Family Court, Motihari, giving rise to Matrimonial (Divorce) Case No. 227 of 2017, in which the complainant-opposite party No.2 has entered

Patna High Court CR. MISC. No.57545 of 2019(2) dt.13-09-2019 2/3 appearance. He has drawn my attention to the statement of the complainant in her written statement and has submitted that the dispute between the parties has arisen because the complainant was not willing to marry the petitioner.

Learned counsel appearing on behalf of the complainant has opposed the prayer for anticipatory bail. However, considering the submission made on behalf of the petitioner, referring to the statement of the complainant filed in the matrimonial case, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sadar, Motihari, East Champaran, in Complaint Case No. C-1880 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail
