The petitioner is languishing in custody since 02.04.2015 in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that though in 164 Cr.P.C. statement the victim has got her age recorded as 14 years but where she has stated that she was going to maternal grand mother's house but she got the way missed and reached to the police station and from there to her parents' house.
Patna High Court Cr.Misc. No.22708 of 2015 (2) dt.10-07-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the victim has denied the accusation of kidnapping, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Hathauri P.S.
