Petitioner seeks bail in connection with Sessions Trial No. 101 of 2016 arising out of Sahiyara P.S. Case No. 61 of 2015 for offences punishable under Sections 353, 193, 194, 195, 120(B)/34,115 and 182 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that during investigation of Sahiyara P.S. Case No. 86 of 2014 under Section 364/34 I.P.C. they get information that the petitioner and others have concealed the abducted person Sanjay Kumar Singh in their own house and lodged a false case, the police conducted raid and recovered the victim Sanjay Kumar Singh. It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.46327 of 2017 (4) dt.12-12-2017 2/2 petitioner that he is innocent and bears no criminal history. He submits that no offence under Sections 353, 193, 194, 195 and 115 of the Indian Penal Code is made out against him and that chargesheet has already been submitted and the petitioner is languishing in judicial custody since 30.06.2015.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge, Sitamarhi, in connection with Sessions Trial No. 101 of 2016 arising out of Sahiyara P.S. Case No. 61 of 2015.
