JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. This an application for grant of bail to the petitioner in a case of misuse of bail.

Initially the case was registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code. The bail bonds were cancelled on 8.5.1997 and right now the petitioner is languishing in custody since 7.4.2015. It is submitted that the petitioner will regularly appear before the court below. The impugned order does not reflect any progress since the petitioner is in custody.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each

Patna High Court Cr.Misc. No.23523 of 2015 (2) dt.13-07-2015 2/2 to the satisfaction of learned Additional Sessions Judge IX, Patna in connection with S.T. No. 346 of 1994 arising out of Kadamkuan (Kankarbagh) P.S. Case no. 526 of 1993. It goes without saying that the learned court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on three consecutive occasions.
