JUSTICE SANJAY PRIYA ORAL ORDER 05-09-2018 This petition has been filed for modification of order dated 22.5.2018 passed in Cr. Appeal (SJ) no. 1356 of 2018 arising out of Warisaliganj P.S. case no. 55 of 2016. Learned counsel for the petitioner has submitted that petitioners have been granted anticipatory bail vide order dated 22.5.2018 passed in Cr. Appeal (SJ) no. 1356 of 2018 but this petitioner could not surrender in compliance of the order dated 22.5.18 because the petitioner was suffering from cancer and was undergoing treatment in Mumbai. He makes prayer for extension of time.

In such circumstances, twelve week's further time is granted to the petitioner from the date of receipt of copy of this order to surrender in the Court below in connection with

Patna High Court Cr.Misc. No.51090 of 2018(2) dt.05-09-2018 2/2 Warisaliganj P.S. case no. 55 of 2016 pending in the court of learned 1st Additional Sessions Judge cum Special judge, Nawada and in that event the petitioner will be released on same terms and conditions as mentioned under order dated 22.5.2018 passed in Cr. Appeal (SJ) no. 1356 of 2018. This Cr. Misc. petition is allowed.
