The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code. The prosecution story, in brief, is that some unknown persons are said to have killed the deceased and thrown his dead body in Hathsar Badhar.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.01.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. It is a case of last seen. The other co-accused

Patna High Court Cr.Misc. No.37228 of 2016 (3) dt.27-10-2016 2/2 has been granted bail vide Cr. Misc. No. 21693 of 2016. On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Danapur, Patna, in connection with Sessions Trial No. 519 of 2016, T.R. No. 398 of 2016, arising out of Bikram P.S. Case No. 120 of 2015.
