The petitioner is languishing in custody since 19.01.2015 in a case registered for the offences punishable under Sections 363, 370, 372 and 365 of the Indian Penal Code. Subsequently, sections 302 and 120B of the IPC were also added. The grand son of the informant namely, Pankaj Kumar went missing leading to registration of the FIR against unknown. Subsequently, the dead body of the victim was recovered with injuries. The name of the petitioner transpired in the confession of co-accused Ganesh Yadav.
It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence and except
Patna High Court Cr.Misc. No.15465 of 2015 (02) dt.12-05-2015 2/2 confession of the co-accused there is nothing collected against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and investigation has already concluded.
It is submitted by learned counsel for the informant that during investigation the complicity of the petitioner transpired.
Considering the suspicious nature of accusation, petitioner has no criminal antecedent and the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Daudnagar, Aurangbad in connection with Goh P.S. Case No. 07 of 2015.
