The petitioner apprehends his arrest in a case registered for offences punishable under Sections 272, 273 of the Indian Penal Code and 47 and 53(B) of Bihar Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that there is no recovery of any illicit liquor from the conscious possession of the petitioner as first information report discloses that liquor was recovered from the house of one Sudama Gaud. Even the seizure list does not show as to from whose possession the alleged liquor has been recovered. Petitioner claims his antecedent to be clean.

No.37918 of 2016 (2) dt.22-09-2016 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Mairwa P.S. Case No. 50 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
