On getting telephonic information, informant, Md. Ismael rushed to the spot and found Feroz, Afroz, Md. Mahtab (petitioner), Phulwa, Dablu and 4-5 unknown persons indulged in brutally assaulting his brother, Md. Israfil @ Sintu who subsequently, died at the hospital. So far this petitioner is concerned, it has been alleged that he was armed with long Chhura.

From the postmortem report, Annexure-2, it is evident that ante-mortem injuries having over the dead body of Israfil happens to be caused by hard and blunt substance. Accordingly, petitioner, Md. Mahtab is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with
