Petitioner apprehends his arrest in connection with Katra P.S.Case No. 155 of 2017 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

Allegation as per FIR is that police on information that some persons were preparing to commit dacoity raided the place and arrested one person, who disclosed the name of the petitioner and further petitioner has criminal antecedent as he is accused in one more case under Section 395 IPC.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and he is on bail in other case.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered by the court below on the basis of materials available on record and if possible to be disposed of on the same day.
