The petitioner seeks bail in connection with Chowk P.S. Case No. 229 of 2019 registered for the offences punishable under Sections 376, 506 of the Indian Penal Code and Section 67(A) of I.T. Act.

The allegation against the petitioner is that petitioner was acquainted with the informant and has taken advantage of that and raped her and also made photo and video of said incident and thereafter started black mailing her. Learned counsel for the petitioner submits that this false case has been filed by the informant as the matter related to love and affairs between the informant and the petitioner and

It is further submitted that the petitioner is man of means and there is no chance of his absconding and tampering with the evidence and further submits that charge sheet has been submitted before the court below.

I have perused the case diary and entire materials available on record. The statement of the victim has been recorded under Section 164 Cr.P.C. in which he stated that the petitioner has forecefully made a sexual relation to the victim and the petitioner is in jail custody since 25.06.2019. In the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.
