JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406, 420 of the Indian Penal Code.

It is a case of dis-honour of cheques.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that three cheques were issued by the petitioner on demand of informant's husband as loan for the marriage of his daughter but marriage was cancelled and on demand the informant returned one cheque but other two cheques were not returned and later on the present false case has been lodged.

Patna High Court CR. MISC. No.66160 of 2021(3) dt.17-10-2022 2/2 informant opposed the prayer for anticipatory bail and submits that petitioner is named in the FIR and there is direct and specific allegation against him that he issued three cheques in favour of informant which were later on dishonoured. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner anticipatory on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
