2. The petitioner seeks regular bail in the present case registered for the offence under Sections 363, 366(A), 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is said to have kidnapped the victim.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 22.03.2024.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. From the statement of the victim girl recorded under Section 161 and 164 of the Cr.P.C., it appears that the
Patna High Court CR. MISC. No.58588 of 2024(2) dt.28-08-2024 2/2 victim was in relationship with the petitioner and had eloped with the petitioner.
7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Sherghati, Gaya/concerned Court below in connection with Sherghati P.S. Case No. 172 of 2024.
