JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Petitioner is languishing in custody since 19.12.2014 in a case registered for the offences punishable under Sections 307, 323, 324, 341, 504, 34 of the Indian Penal Code.
It is alleged against the petitioner that he caused injuries with spear on the abdomen of the informant. From the impugned order of learned 2nd Additional Sessions Judge, West Champaran at Bettiah, it appears that the injury report was not produced along with the case diary.
The learned A.P.P after going through the case diary submits that without obtaining injury report chargesheet has been submitted which reflects the manner in which the I.O. has conducted the investigation.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.8506 of 2015 (3) dt.14-05-2015 2/2 petition that petitioner has no criminal antecedent. Considering the fact that investigation has already concluded and the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 252 of 2014. Let this order along with the case diary be transmitted to the Superintendent of Police, West Champaran at Bettiah to see the manner in which the investigation is being conducted within his jurisdiction.
