JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-11-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 10.02.2016 passed in Cr. Misc. No. 42882 of 2015, on the ground that the petitioner is suffering in custody since 26.06.2014, only charges have been framed and no prosecution witnesses have been examined and as such in near future the trial is not likely to be concluded and as such the petitioner deserves sympathetic consideration as there is no specific allegation against the petitioner. The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the petitioner and other co-accused shot the deceased by firearm and in the postmortem report the
Patna High Court Cr.Misc. No.48176 of 2017 (3) dt.15-11-2017 2/2 doctor has found five gun shot injuries on the person of the deceased.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with S.T. No. 260 of 2016 arising out of Halsi P.S. Case No. 131 of 2012 pending in the court of Additional District & Sessions Judge-1st, Lakhisarai.
