JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with complaint case No. 2253C/2013 for the offence under section 498A of the Indian Penal Code and section 3⁄4 of Dowry Prohibition Act.
The prosecution story, in brief, is that the complainant has been tortured by the accused persons including the petitioner for non-fulfillment of demand of motor cycle after marriage, as more dowry.
It has been submitted on behalf of the petitioner that the matter has been settled between the petitioner and the
Patna High Court Cr.Misc. No.24299 of 2015 (2) dt.13-07-2015 2/2 complainant and the complainant is residing with the petitioner. It has been submitted on behalf of the State that the petitioner is named in the complaint petition. Considering the aforesaid facts, the court below is directed to verify the aforesaid fact by obtaining personal appearance of the complainant in the court below and if the same is found to be true then, the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Samastipur in connection with complaint case No. 2253 C of 2013, T.R. No. 4405/2014 subject to condition as laid down under section 438(2) of the Cr. P.C.
