This is the second attempt on behalf of the petitioner for grant of bail in connection with Matihani P.S. Case No.163 of 2023 registered for the offence under section 120-B, 302, 326/34 of the Indian Penal Code and under section 27 of the Arms Act.

Earlier, the petitioner and other co-accused persons have filed Criminal Miscellaneous Nos.36895 of 2024, 38504 of 2024 and 55646 of 2024 for grant of bail and this Court vide order dated 18.04.2024 has rejected the same. The entire order dated 18.09.2024 reads as under :- "Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek regular bail in connection with Matihani P.S. Case No.

163 of 2023, lodged under Sections 120(B), 302, 326 and 34 of the I.P.C. read with Section 27 of the Arms Act.

3. As per the prosecution case, the petitioners are said to have fired upon the deceased. The deceased has sustained a number of injuries.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioner nos. 1, 2 and 3 are in custody since 21.12.2023, 14.12.2023 and 28.03.2024 having one, one and no criminal antecedent respectively. The petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them by the Court.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that there is direct allegation of indiscriminate firing upon the petitioners, which is heinous offence.

6. Considering the direct allegation of indiscriminate firing upon the petitioners, I am not inclined to grant bail to the petitioners and therefore, the present bail applications are hereby rejected."

In the opinion of this Court, no fresh ground for review of earlier order is made out. Accordingly, this bail

Since the charges have been framed in the case, the Superintendent of Police, Begusarai is directed to ensure the appearance of the witnesses on the dates fixed in the trial so that the trial is not delayed.
