Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Panjwara P.S. Case No. 44 of 2022 lodged under Sections 30(a) and 32(2) of Bihar Prohibition and Excise Act, 2018. As per the prosecution case, total recovery of 314.775 litre wine has alleged to be made from the possession of the petitioner.

Learned counsel for the petitioner submits that the antecedent of the petitioner is clean and he is in custody since 18.04.2022. Counsel submits that petitioner is the co-driver of the alleged vehicle from where the recovery has been made.

No.55896 of 2022(2) dt.02-12-2022 2/2 Counsel further submits that the Co-ordinate Bench of this Court has pleased to grant bail to other co-accused vide order dated 20.08.2022 passed in Cr. Misc. No. 40501 of 2022. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Session's Judge-Vth, Banka in connection with Panjwara P.S. Case No. 44 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
