The petitioner apprehends his arrest in Bihta P.S. Case No. 46 of 2014, registered for the offence punishable under Section 302 of the Indian Penal Code.
The petitioner is alleged to have assaulted his wife with Basula a sharp edged weapon on different parts of her body. During the course of treatment the wife of the petitioner died. It is submitted that the petitioner had no intention and motive. Some altercation took place between the husband and the wife and the wife fell down on Basula, a sharp edged weapon. Considering the facts aforesaid and the fact that there is very specific allegation against the petitioner that he assaulted his wife with a sharp edged weapon and on account of injuries the wife of the petitioner died, I am not inclined to enlarge the
Patna High Court Cr.Misc. No.23895 of 2015 (2) dt.14-07-2015 2/2 petitioner above named on bail. Accordingly, the same is rejected. However, the trial court is directed to expedite the trial and conclude the same within nine months.
