The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code, different sections of Arms Act, section 3⁄4 of Explosive Substance Act and section 17 of C.L.A. Act.
The FIR was lodged against nine named and 50 unknown persons. The informant alleged that extremists made firing and fled away. The petitioner is named in the FIR but nothing has been recovered from the possession of the petitioner. The petitioner was apprehended by the police and his confessional statement was recorded but except the confessional statement the investigating officer did not collect any cogent evidence nor the petitioner was put in T.I. parade although he is in custody since
Patna High Court Cr.Misc. No.30062 of 2015 (2) dt.11-08-2015 2/2 01.10.2013 and similarly situated accused, namely, Arbind Bhuiyan and Anil Yadav have already been enlarged on bail. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Aurangabad in S. T. No. 280B/2012/7/2014 arising out of Madanpur P.S. Case No. 61/10.
