JUSTICE RAKESH KUMAR ORAL ORDER 28-10-2016 Heard Sri Nagmani Kumar, learned counsel for the petitioner and Sri Rajendra Prasad Nat, learned Additional Public Prosecutor.

The sole petitioner who is in custody only since 2.5.2016 in Phulwari Sharif (Janipur) P.S. Case No. 262 of 2015 registered for the offence under Section 395 of the Indian Penal Code has prayed for grant of bail.

Learned counsel for the petitioner submits that F.I.R. was lodged against unknown and only on the basis of confessional statement of some of the co -accused petitioner has been made accused.

Learned Additional Public Prosecutor opposing the prayer submits that in the case diary there is sufficient material.

Patna High Court Cr.Misc. No.40586 of 2016 (3) dt.28-10-2016 2/2 Besides this, petitioner is having criminal antecedent and such fact has been stated in paragraph no. 3 of the petition. Keeping in view the nature of accusation and criminal antecedent of the petitioner, I do not find any ground to grant bail to the petitioner.

The petition stands dismissed.
