ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.05.2017 in connection with Rahika P.S. Case No.42 of 2015, corresponding to G.R. No.799/168 of 2015, registered for the offence under Sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that entirely fabricated case has been lodged against the petitioner. He further submits that the petitioner has clean antecedents and two other co-accused have been granted bail by this Court in Cr. Misc. No.26490 of 2015, vide order dated 27.07.2015 and Cr.Misc. No.860 of 2016, vide order dated 11.01.2016. It is

No.38139 of 2017 (3) dt.21-09-2017 2/2 further submitted that the case of the petitioner stands on better footing to that of the said co-accused who have been granted bail because he had not withdrawn any amount. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on their furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Madhubani, in connection with Rahika P.S. Case No.42 of 2015, corresponding to G.R. No.799/168 of 2015.
