JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Having been lodged in jail custody since 17.04.2017 in connection with Laxmipur P.S. Case No. 56 of 2017, registered under Sections 399 and 402 of the IPC and diverse penal provisions of the Arms Act, the petitioner prays for bail. On a tip off police goes to a place in the day and arrested one co-accused while trying to flee away. On his disclosure, the petitioner, co-accused(s) Madan Yadav and Dilip Kumar Yadav were arrested from the nearby place. From the possession of the petitioner one country made pistol was found. Learned counsel submits that co-accused Dilip Kumar Yadav from whose possession one live bomb was recovered has since been granted bail by order dated 20.09.2017 passed in Cr. In view of the above, this Court is inclined to release the petitioner on bail. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd, Jamui /concerned Court, in connection with Laxmipur P. S. Case No. 56 of 2017, subject to the condition that one of the bailors of the petitioner shall be his own/close family member and no sooner the charges are framed in the case, the petitioner shall appear in person on each date fixed at the trial. In case of default on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
