The petitioners have preferred this application for grant of regular bail in a case registered under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 909 litres of IMFL was recovered from the vehicle being driven by the petitioner no. 1 and in which the petitioner no. 2 was also present. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. No incriminating article has been recovered from their possession or from the vehicle. They are in custody since 27.9.2021 and have no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration recovery of 909 litres of IMFL from the vehicle being driven by the petitioner no. 1 and in which the petitioner no. 2 was also present and the petitioners being arrested on the spot along with the seized liquor, the Court is not inclined to enlarge the petitioners on bail and the application is rejected.

Liberty is granted to the petitioners to renew their prayer for bail on completing one year in custody. (Partha Sarthy, J) Spd/- U T
