JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In huge quantity, bottles of country made liquor were recovered from a room of the market complex, which belongs to Binda Devi, but the informant claims that the aforesaid Binda Devi is none else but is the relative of the petitioner and, as a matter of fact, on the eve of election, petitioner had stored country made liquor and was distributing the same amongst the voters but when raid was conducted, petitioner managed to escape from there on seeing the police party.

Considering this aspect of the matte that neither the said recovery has been made from conscious possession of the petitioner nor from his house and co-accused Binda Devi, from

Patna High Court Cr.Misc. No.40436 of 2016 (2) dt.29-09-2016 2/2 whose market complex the said recovery was made, has already been granted privilege of anticipatory bail by a co-ordiante Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Barhariya P.S.Case No. 69 of 2016.
