The petitioner being the husband of the informant is languishing in custody since 20.08.2016 in a case registered for the offences punishable under Sections 498(A), 313, 419/34 of the Indian Penal Code and 3/4 Dowry Prohibition Act. Prosecution case is that the informant fell in love with the petitioner and on 30.05.2016 she got married with the petitioner according to Hindu rites and rituals at Arya Samaj temple. After sometime, the informant got pregnant but the pregnancy was terminated on 16.08.2016 at Astha Hospital against the wishes of informant thereafter the informant was assaulted

It is submitted by learned counsel for the petitioner that the informant was earlier married with Shanti Kumar Prasad, village Ewatpur, Nawada and is still in relationship with said person. Subsequently, the informant on 08.08.2016 got separate from the petitioner and swore affidavit to that effect. Considering the nature of accusation and the inconsistent stand of the informant, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna in connection with Mahila P.S.
